Legal Question in Criminal Law in Florida

stolen identity

My identity was stolen and i was charged with whatever the person did under my name. I was charged with assault and battery and license suspended/revoked. Now i would like to know how can this be me if the state gave me my license back because it was proven theft why they charged me? Plus i was supposed to be sent to miami after the bond was paid but they sent me to another facility and my job is on the line because of this. Please tell what can i do while sitting behind bars and my family is out there suffering?

Unfortunately there is not much that you can do while you are locked up; however, you could hire an attorney who could begin to gather the evidence that will be necessary to prove that you are not the person that they want.

Unfortunately, that is becoming a bigger and bigger problem. You need to hire an attorney to file a motion to have the case removed from your criminal record. The police will fingerprint you, and then compare your prints to those of the individual who was arrested and used your name. When they dont match, they will put a warrant out for the correct person and remove your name from the case.
