Legal Question in Criminal Law in Florida

How can I stop a investing case about me dating a minor. She was pressured into confessing and the first time she was interviewed she said nothing. The 2nd time she confessed to having sex with me 10 or more times. The detective called me and wants me to go in to talk to her. I changed my phone number recently. I told her she can come to my home to talk about it but she wants me to come to the police station to "talk"?? If they havent spoken to me and they dont speak to me will this go away? Can me and the girl that is a minor do something to end this case without it going any further? What will happen now if the detective cannot contact me?

Your "issue" probably isn't going to go away on its own. I would recommend seeking the advice of an experienced criminal defense attorney in your area. The police have enough to bring their case to the State Attorney's Office to review and/or put a warrant out for you (based solely on the child victim's testimony). Therefore, you need to get an attorney ASAP.

I would NOT, under any circumstances, recommend going into the police station to speak with the Detective without having an attorney present.

Good luck,

By the time they contact you they have usually gathered enough information to go forward and are probably hoping that you will come in and give them their case on a golden platter.

As the other attorney mentioned, I would not go in (or have them come to you) to give a statement.

Remember that the government has the burden of proving you committed a crime; they have to do this with evidence, don't give them any more than they already have.

Also remember that you have a Constitutional ( 5th amendment) right to remain silent, I recommend you exercise this right.

You also have a 6th amendment right to an attorney of your choosing. I handle cases in Dade county and would be glad to chat further with you; feel free to give me a ring.

Take care,

-Leland
