You can get an attorney to fight for you. You have a right to a speedy trial and that right can be invoked at any time in the proceeding. But be careful because the state can sometimes prove its case without this witness. I practice criminal law in Miami and have seen the prosecutors go ahead on a case based on 911 tapes and officer testimony many times. You have to be careful when demanding a trial because you might just get one that is not to your advantage.
