Legal Question in Criminal Law in Florida
suppress testimony
My husband was arrested for first degree felony. Can we file a motion to suppress what the accuser what said at the police during her testimony since she is an illegal immigrant, she does not speak English as a first language and there was no translator made available? They did not understand her(even on tape) and the assistant state attorney had tried to translate for her. Moreover, then she came for her deposition without any subpoena. Can we use this to say that her deposition is illegal?
Thank you very much.

Re: suppress testimony
An attorney needs to file such a motion unless the judge is allowing the person to represent herself
