Can a suspect be charged with a crime before being questioned?

Absolutely yes. In fact, suspects/defendants have a right to remain silent. Even though the police do often try to get information from the suspect (usually to use against the suspect) it is not always necessary. Lots of people are charged with crimes every day without the police ever trying to get a statement from the accused.
