Teenage daughter

My daughter did the diversonary program and completed all of the requirements, How do I get the record sealed, or will that automatically happen? How does she answer the question on a job application if she has ever been convicted?

Once she has complted the program requirements and the time period has expired, the State Attorney should file a dismissal of the charge. Therefore, there is no conviction on her record however the charge will stay on her record. If you are interested in having her record sealed or expunged, it is advisable to hire a experienced attorney to represent her as the process is long and at times confusing.

If your daughter was in the diversion program the state should have nol prossed (i.e. dismissed) the case once she completed. With that being said, she has the right to expunge her criminal record so long as she does not have any other convictions for other criminal matters. Even if she does not expunge her record she can honestly tell potential employers that she has never been convicted of a crime (so long as this is the only thing she has ever been involved in).
