Legal Question in Criminal Law in Florida
Theft History
I was recently charged with grand theft 3rd degree. I have a past theft by decption (around 15 years ago)in another state. I am not sure if the current state is aware of this. There was no mention of the priors at the arrest, bond was $1000. An attorney has stated they will probably not find out about the prior. Is that true, or is it possible the state attorney may dig further and find out. If they do find out, will I be looking at mandatory jail time? Thank you

There is a national criminal history database known as NCIC and almost every state attorney checks it when opening a case. However I don't think it will result in the State offering jail. You will probably get off on probation.
