Legal Question in Criminal Law in Florida

theft

at a retail store i took a rign set out of the tag to try on but it broke, i left it by the clothes, then on my way out i got another (8.99) ring out of the price tag and put it on, walked around and then out of the store with the ring. security grabbed me and took to office and called the police. they showed with the broken ring i left behind too, they said they have me in tape. police officer gave me a paper he said its a ticket, and told me to wait to hear from the court. i have no records, never had any legal problems before, what can i expect? is it a good idea to hire a lawyer for this? please, help. i'm so embarassed!

Yes hire a lawyer and maybe get off with a warning/fine, no record.

You may be able to avoid prosecution for this if it is a misdemeanor and you have no prior criminal record, assuming it occurred in Miami-Dade County. You may want to contact an attorney for this issue to ensure you receive good representation. You may also want to seal or expunge your record when the case is over. You were probably charged with a misdemeanor of retail theft. You may be able to have your case taken out of the system and referred to a diversionary program for first time offenders. While the program may be offered by the State Attorneys Office to you without counsel, it may be sought by your attorney if you are represented by one. At the least, it would be a good idea to consult an attorney so you know what are the proper steps to follow when you go to court as a public defender is only offered when the State is seeking jail time for which this case should not apply.
