Theft

I work for a company that uses certain documents that were drafted by the owner. A co-worker of mine has been preparing those documents for customers and charging a fee for those documents.

The co-worker tells the customer that the documents are being prepared by the company, but takes the payments for himself. He does not pass any of the earnings on to the company. He told me I could make a lot of money this way, but I think this is a crime, so I want to know if its okay to do this. If it's not a crime, do you think my boss could fire an employee if he found out what was going on? Also, could my boss sue an employee who did this?

Your co-worker is stealing from the company and very easily could be charged with theft. I strongly recomend against this as your boss could seek to recover monies from your co-worker as he and his business are legally entitled to the monies being deverted.
