Because the value is less than $100.00, the theft of the shirt is a second degree misdemeanor punishable by a fine of $500.00, 6 months of probation and 60 days in jail. If adjudicated guilty there is a six month driver's license suspension for a first offense and a 12 month suspension for a second offense. If the instant charge is a second offense then the penalties increase to a first degree misdemeanor-A third offense is a third degree felony.
