First time Offender in Florida...

Hi my husband has been arrested for lewd and lascivious battery of a minor under 16,tampering with a witness.He has never been in trouble with the law before. His Public defender had him take a sex offender Evaluation and he passed. what can we do to get him out of jail?

You have to seek a bond reduction and then bond him out. In Fl being a first timer doesnt matter, it goes by points. His charge is extremely serious.

I think I was responding to one of your questions yesterday. I do not want to interfere with your lawyer's advice. You should ask his atty. to file a motion to get his bond reduced or to get him let out without a bond, unless that has already been tried. Sometimes, the State will agree to reduce a bond. If you have new evidence that exonerates him of this crime, this may help negotiate with the State re: his release or, more importantly, the charge itself. Take care. Tom Rosenblum
