Legal Question in Criminal Law in Florida
Someone told me that a consperiecy to commit in drug trafficing carries a one level lower charge than the trafficing its self. How does that work with the mandentory sentence? If its 14g to 28g does that mean you would get a 3yr min instead of 15yr, and what happenens if its a 4g to 14g charge the lowest trafficing charge would the consperiecy a lower level to and if so how does that work? A conspiracy count is equivalent to the actual charge, in this case trafficking. it is not a lower offense. Of course, with a conspiracy, you are only liable for the drugs that involved you personally, including those you dealt with, possessed with, bought, sold, discussed, etc. Talk to your attorney for the specifics in your case.
