Legal Question in Criminal Law in Florida
zero tolerance for probation violaters
I already have a court date to modify probation on 4/20 to add drug treatment but have just had a positive UA. My p.o. says it is the judges discretion to issue an arrest warrant as I have a court date already. In view of the zero tolerance law do the judges still have this discretion? My original charge is a drug charge if this has any bearing. Thank you

Re: zero tolerance for probation violaters
Judges do have the discretion whether or not to issue the arrest warrant, but 99.99 out of 100 they will issue the warrant. If I was you, try to get your case on the judges calendar before the warrant is issued and the 4/20 date. It is not a guarantee that the judge wont take you in for the violation on the spot, but at least it will show that you are trying to own up to your alleged actions.
