Legal Question in Criminal Law in Florida

Travel Int'l while out on bond -- before court day

I live in Broward Co Florida and my employer requires me to travel on a fairly regular basis. I go a felony charge and am scheduled for court on May 31, 2007. Is it legal? My attorney says I can take a risk, however it would be uncomfortable traveling with a black cloud over my head and the possibility of incarceration. Please help -- thank you

Yes, you can travel. However, you must obtain permission from the court.

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

This sounds like a previous question. Generally, a person out of jail on bond is NOT allowed to travel out of the jurisdiction of the court which may include to another county. Certainly, travel to a foreign country will be prohibited without permission of the Court.

I strongly suggest that you have your attorney file an emergency motion to allow you to travel to the country you are planning to go to prior to leaving. Failing such, you face the possibility of arrest either upon leaving or upon your return.

Additionally, the Court may revoke your bond if you are able to successfully travel and it becomes aware of your violation of the bond.

This is a very serious matter and should not be taken lightly. You have an attorney and should listen to his or her advice.
