Trespass and Contributing to the Delinquency of a Minor
Can my son be arrested for trespassing and contributing to the deliquency of a minor? He is 18 yrs old; was found with four other boys (ages 17 to 19) in the home of a fifteen year old girl (two other 15 yr old girls also present); alcohol was in use; (no proof as to who brought it in). The girls mother has phoned me to say she was going to have my son arrested for the above. Is this possible seeing that he was INVITED into the home by the girl when her parents were out? Is he responsible for the alcohol being there? It was transported there in a car in which he was riding, but was bought for them by a boy over 21 yrs. Thank you.

Unfortunately anything can happen these days. Law enforcement can charge him with an offense based on a sworn affidavit. Depending on whether they charge him with a misdemeanor or a felony will determine if he is arrested or just summoned to court.
As far as who brought what and where - my advice is to keep everyone's mouth closed. Your son has a right to remain silent - utilize it. I had no idea who brought it to the house until you told me, the police won't either UNLESS YOU OR SOMEONE ELSE TELLS THEM.
