Trespass & Drug Possession
Looking for information on the probable outcome of drug cases in Florida. I have somebody charged with Poss of a Controlled Substance with Intent to Sell (w/in 1000' of University) and Poss of Cannabis over 20g. 4 days later the same person was charged with Trespass on Prop other than Struc or Conve (Universtity). What is the probability of getting probation/intervention or other program without any jail time with these charges? The Trespass is a separate court date and charge, but obviously don't help. First time offender. Any ideas/suggestions out there? Thanks!

As charged, the person faces at least 3 years mandatory prison. That doesnt mean, thats what he will plea to, but as charged, there would be no probation.

It depends on the quantity and packaging of the drugs and a few other variables. Usually the police overcharge drug offenses. The critical thing is what the state attorney actually files. You need an attorney to intercede at the earliest possible time in order to advocate to the SAO prior to the formal charging decision being made. What county is this?
