Legal Question in Criminal Law in Florida

I sent this to someone, but can u read it and see if u can give me any advice, PLEASE!

Hello, my name is Gladys Christian. I have a brother named T Nalley that lives in Jacksonville, Fl. He has been locked up since April 24, 2009. I don't know who to turn to, all I know is I have to help my brother. I guess I'll keep writing til someone will help. A Federal Agent even said that something isn't right, either T. is hiding something or he may have a lawsuit for the way he's being treated. I believe he's being treated unfairly. Not because he's my brother, but the punishment doesn't fit the crime. This is what He told me happened.

First of all, he has dated Ellie (she's his roommate and the one pressing charges) in the past, but has moved in to help her as a roommate. They would argue, even at times Ellie put her hands on my brother, but he never hit her. On April 24, 2009, they were arguing that evening. T. said he tried 3 times to go to bed, but Ellie continued to argue and yell. So T. got out of bed, went into the kitchen and was arguing back. I know Ellie, she is a nag, not an easy person to live with and takes all kinds of medications for health problems. She's either 10 or 11 yrs older than my brother. Well T, goes into the kitchen, argues back and Ellie threatened to kick him out. T, threw her on the floor and she was kicking and trying to punch him. He then put his hands around her neck and told her, THAT WAS ENOUGH! He then calls 911 for her, thinking he may have hurt her back. In the meantime, Ellie is screaming out, he's trying to kill me. I know that isn't true. She's taller than he is, my brother is pretty short. My brother was arrested that night. If I was trying to kill someone, I wouldn't call 911 for them. I didn't know my brother was locked up until my son found it through the computer. So when I read his inmate search, I freaked out. They have him for murder/ premeditated/ first degree. This has caused a lot of stress on me and my son, the way we found out. We thought he really did kill someone, but we couldn't find anything out. I even tried to call Ellie, but her phone was disconnected. That's how she is, she's a heartless woman, she could have at least let us know. I had to get my ex to find out, he still lives in Jacksonville. He spoke to T. and Ellie and my ex said their stories pretty much match. So why is my brother not in there for battery or domestic violence? His bond is $250.003.00. He had a cell mate that choked his girlfriend with a chain and he got 8 months. Something isn't right, . I know he should have never put his hands on her, he even knows that, but why would he get murder? I was told that they knocked it down to aggravated battery, but his inmate search or bond hasn't changed. Even with that, he could get up to 10 yrs. I think his public defender told T. they are trying for 4 yrs. My god, that's still way too long.

My brother has helped Ellie out alot. Helped with bills, helped with her dog grooming business, he ran it a lot while she was home because of her back. Even a few days before this fight, he paid $850 for a new fridge, which she is enjoying! I think she used my brother and this was her way of kicking him out. She has a restraining order against him, which is great, they don't need to be together, but to treat him like a murderer, no, it's not right. I'll be the voice for my brother, I love him dearly and I know he's a good guy. No one is perfect and I think he did lose his temper, but he did enough time, why is it going on and on?

Here's another thought: he's lying to you, he tried to kill her, he has priors so he's looking at more time than the other guy he talked to.

I'm not saying that's the way it went down, I'm just suggesting it as a possibility. I'm almost certain that's how the prosecutor sees it.

Anyway, your best bet is to go hire a good criminal lawyer who can present a case to the jury from your perspective, which will allow him to be found not guilty.
