Legal Question in Criminal Law in Florida

Underage Possession

I have a question similar to one before me about underage possession. I am 19 years old and I was caught with a beer in public and was totally honest and told the police what store I bought it from(which I regret). So now the store owner is going to get in trouble for not IDing me. My question is whether I am going to have to testify against the store and since I am worried about getting into college, should I get a lawyer. If so, is it an affordable option?

Re: Underage Possession

First, the State can compel you to testify against the store owner under the subpoena powers of the court. However, you would be able to assert your 5th Amendment right against self incrimination to the extent that it applies to your case. Second, you need to consult a lawyer. A first offense possession of alcohol charge is punishable by up to sixty days in jail and by a fine of up to $500.00. A lawyer can evaluate the strengths and weaknesses of your case, seek to obtain a dismissal, negotiate a resolution with the State or Judge or take your case to trial.
