Legal Question in Criminal Law in Florida
un-employment compensation
I have a Question...I was recently discharged from my job for using my employers gas card for personal use. When I was terminated he deducted the full amount of the charges from my last paycheck and he then threatened me with criminal charges if I applied for un-employment, which I need to do because of the lack of jobs in my area. Can he legally have me charged even though he was fully compensated for his loss due to me using his gas card? I need un-employment comp., what should I do?

Yes he can still have you charged. Plus, you dont get unemployment when you are fired for stealing.

You have two problems. Your employer can still report the theft to the authorities and it is up to them to decide whether or not to file charges.
More importantly, if you are discharged (fired) due to theft, you will not be entitled to collect unemployment benefits. You cannot be discharged for valid cause which theft most certainly is.
