Legal Question in Criminal Law in Florida

Are video depositions mandatory

My minor son received a letter from the Public Defender's office, they state that he is a witness to a crime but he states that he knows nothing of the situation. Are the video deposition really mandatory?

Re: Are video depositions mandatory

If the "letter" was a subpoena, then yes, it's mandatory. If it's just a letter that came through the mail, then no, it's not mandatory.

Re: Are video depositions mandatory

If your son received a subpoena to testify at a deposition, he will need to show up and honor the subpoena (or face the possibility of him (or you) being held in contempt by the Court for failure to appear). If he knows nothing about the case or situation at hand, he should just be honest and explain that. If that's the case, his depo will be very short and easy.

Good luck.
