Viloation of Probation

I am currently battling Highlands County on a misdemeanor vop warrant from early 2004. I left the county without telling probation (I have never been in trouble before). I did not realize the severity. I was arrested after ruuning a red light for the vop in Palm Beach. I was able to bond out after spending two weeks in Palm Beach County then transferred and spent one night in Highlands Cty Jail. The plea deal they want me to do is either 45 days in jail or 6 mos weekend community maintenence. I am currently HIV + and need my meds. My lawyer tells me that meds will have to be provided by me if I go to jail and not the county as he said it takes 30 days for approval thru the jail.

Any advice. I do not want to do any jail time.

It's hard to say without knowing your background, etc. Simply not going to probation and being away for that amount of time can often result in a prosecutor to seek jail time. Perhaps you can give some medical documentation to your attorney to show the prosecutor or Judge. This may help minimize the sentence. Maybe you also can get something from a doctor stating that you can do too much physical work. This would mean the 6 mos weekend duty is not really an alternative to the jail, so maybe a different alternative can be worked out....maybe home confinement?
