Violation of Felony Probation charges
My Fiance' was charged with 2 counts of controlled substance without prescription. He was placed on probation for a year. He did about 4 months and violated with a posti==itive drug test and a new charge. New charge is dealing in stolen property. His lawyer is trying to have him plea guilty to the vop drug test, and either not guilty on the other or guilty to an arrest. But if he pleas guilty all around on the new charge, when he goes to court for that he'll be screwed. So pretty much I want to know can you really plea guilty to one vop and not the other. If so what are the regulations, what might you suggest that i can possibly tell his lawyer to try. the states office is being a real pain, they want him to plea guilty to all and go to prison. I think that's a little much. They also have no remorse those bastards because he was let out on a 7 day furlow for his brothers funeral etc. please help, i just want to get him out as soon as i can.

Violation of Probation charges are often resolved by making an admission to only part of the violation allegations contained in the affidavit. VOP charges are much easier to prove than other criminal charges and unless defendable, negotiation of a sentence with the State Attorney is the typical outcome.
