Legal Question in Criminal Law in Florida

Violation of Probation

If I've been violated for failing to report, and have paid all debt for supervision what should I do? Keep in mind that I don't want to go back to jail whether it's county or a state correctional facility!

Re: Violation of Probation

I just saw your question and will give a quick response. I do not have all the facts, such as the underlying charge, whether there has been a prior violation, whether this is a misdemeanor or felony, so I can only be general.

If you have a VOP, you need to come into court with as much of the requirements satisfied that you can. If the ONLY violation is that you failed to report, you should have a good story to tell as to why. As for the procedures, you come into court initially and deny the violation and ask for the case to be passed for a few weeks. If you have an atty., he or she can contact the State Attorney and try to negotiate a deal to get the least amount of any sentence as possible. Eventually, if no deal can be reached, the Court will set the matter for a hearing...which you don't want!

If my office can be of any assistance, give us a call. Good luck. Tom Rosenblum
