Legal Question in Criminal Law in Florida
violaton of probation
i was put on felony probation for habitual traffic offender. After the conviction one of the driving charges was dropped and the state of florida changed my status and allowed to get my drivers license. While on probation my officer violated me for not paying all fees and not attending drug counseling. shouldnt my probation have been terminated since i am no longer considered a hto offender?

Re: violaton of probation
The unfortunate answer is no. Under Florida law, you are not to drive while your license is revoked as an HTO, even if you are fighting the basis for that revocation and eventually win.
However, it would likely be good mitigation at a VOP.
