my boyfriend is in jail for a violation of probation. his original charge was a violation of injunction for a supposed phone call. When he was arrested for the violation of injunction, he stayed in jail for 46 days and was then released on probation. he violated the probation for not showing up one day even though he called to explain his situation. my question is, will the 46 days that he did on the original charge count towards the jail time that he does now for violating his probation?

Yes, not only will the 46 days count but he will also get credit for any time that he may have done when he was first arrested (if he was arrested).

He will receive this credit unless he waives his right to it on the record.
