The Florida legislature has provided judges with guidelines for sentencing criminal defendants. These guidelines identify offense levels and assign point values to specific offenses. The points per offense are added up along with legal status points and points associated with a new felony conviction. Then the total points are plugged in to a formula which provides a minimum sentence which could be imposed by a judge. However, the judge is not always bound by this minimum sentence: more time or less time could be given. If your husband is in jail, you need to talk to an attorney as soon as possible so that he or she can assess the prior sentence, evaluate the new charges and minimize his exposure to jail time.

fleeing and eluding carries a 5 year prison term. He has done it twice, therefore he could be looking at 10 years on those two charges alone. But that is not to say that that is what the final outcome will be. Please consult his attorney for more particulars as to his individual case.
