Legal Question in Criminal Law in Florida

Warrant for arrest-do they run out after so many years?

My neice has a warrant for her arrest, violation of probation of using cocaine, she was tested postive and this is her 2nd violation. She moved before the warrant was issued and has been straight for 2 years now. She doestnt want to spend a year in jail obviously but she sais she would probably end up doing drugs again if she did do the time because in jail she would be surrounded by dealers and drug users and she wants to stay away and stay straight. Where she is now, she is happy and productive but leading a unamimous life. She cant do much but wants to be a productive person. If she waits it out, will the warrant no longer exist? Is there a statute of limitations on a warrant? Please help me to help her, she only wants to stay straight and out of Jail. Thank you

Re: Warrant for arrest-do they run out after so many years?

There is no statute of limitations for violating supervision. By running she has caused herself more harm - she has started over but still has this to deal with. With the little info that has been given, she needs to realize that the only way to get past this is to confront it head on. She needs to hire an attorney and prepare herself to face these accusations. The is no guarantee that she will not be sentenced to some form of incarceration. However, it sounds as if she has or had a drug problem and she may be sentenced to drug rehab instead of incarceration. Not counseling every Wednesday, but in patient care. The passage of time will only make it more painful when she is picked up. Call me if you have questions.
