Legal Question in Criminal Law in Florida
On Wednesday, January 29, AD 2014, a male Physical Education (PE) teacher yelled at my child and yanked up my 8 year old little girl' sweater hoody, lifting her up to a standing position in front of all her classmates. My child takes a speech therapy class at the same school campus and has anemia and thyroid disease and hence she is not as strong as the rest of her class at Apollo Elementary School in Titusville, FL. Brevard County. I believe that this is inappropriate physical contact and unjustly humiliating my child in front of her classmates, since he was the only adult teacher in that class. My child does not have any disciplinary issues. She is an all A's and all O's student. The PE teacher denies any wrongdoing and argued that he did not remember the incident per the results from an investigation given to the Brevard County North Area Superintendent.
We demand that the PE teacher be removed from his position since my child is scared to take PE classes with that teacher. Apparently he is the only PE teacher at that school and a bringing another teacher is out of the question per the Brevard County North Area Superintendent response today.

You need to talk to a civil lawyer. They handle contingency cases which would not require any money up front. It is possible that he acted criminally, but in that case, you need to contact the police, not a criminal defense attorney.
