Legal Question in Criminal Law in Florida
hi i was wondering what state has the shortest average sentencing for property crimes such as car theft and burglary?
1 Answer from Attorneys
There is no easy answer to your question. The minimal sanction is a fine. The max is 5 years for a 3rd degree felony (Burglary Conveyance-car) or up to 15 years for a 2nd degree (Burglary of a Dwelling). There can be other factors that raise the sanctions as well. But generally that is the minimum and the maximum. Every case is different and every defendant is different. The prior record and the scoresheet play a big role in how they are sentenced. It is not uncommon for a person to get probation on a 3rd degree felony. It is less common on a 2nd degree felony.
