Legal Question in Criminal Law in Florida
If I am working through a drug counseling program on pretrial diversion and my counselor contacts me after hours from a private phone wanting to develop a personal relationship and admits to wanting to use drugs with me, what is my best course of action? Is this means to have my case thrown out?

This is something that must be brought to the attention of the judge. However it is probably not grounds to dismiss your case. You may want to contact an attorney to work as an intermediary since these are very serious accusations
This is not a basis to get your case thrown out, at all. If you have voicemails, email, text messages, or any other kind of proof that this person is making inappropriate comments, bring this evidence to a supervisor and your attorney. But the impropriety of a drug counselor is not something that would cause the State Attorney or judge to drop the charges against you.
