Legal Question in Criminal Law in Florida
Wrongful Death, Police Pursuit of Motorcycle
My ex-husband was killed riding a motorcycle in a police pursuit. The details of the accident and investigation are complicated but the motorcycle belonged to a man who was a 'friend' of my exhusband. He had done private home repair for this man and instead of paying him cash he bought the motorcycle for him. This man did not insure the motorcycle, but registered the tag in his name and let my ex drive it. They had spent the week living in a hotel in a rural area where this man owns a lot of property and knows a lot of people. After hours of partying, he allowed my exhusband to take the motorcycle at 3 am to go to the store. A Police deputy saw him speeding and attempted to stop him, a chase lasted for more about 20 miles down dark, rural, dirt roads and he hit a tree. There are a lot details to the story but I am trying to make it as simple as possible.
Could this man be held responsible for his death? What are his ownership liabilities? Would this be criminal or civil?
My ex only had the motorcycle for 8 days before his death.
The first business day after the accident the police released the motorcycle to this man. With a crash/accident investigation and a homicide investigation pending!

Re: Wrongful Death, Police Pursuit of Motorcycle
He has no criminal liability. I would think the police would be your only potential litigants.
