Wrongful VOP

If a person is on an ankle monitor and it is suppose to go off when they are not where they are suppose to be. Can they Vop a person with out when he did have permission to be out of the house and his ankle monitor did not go off? If a person is charged with felon in possession of a fire arm but it was not found on his person or in the same place as him and there is a picture proving who the owner is can that charge be dismissed? And if a person is also charged with a burglary of a dwelling but it is a he said she said case and another person had already confessed to comitting the crime and the person wrongfully charged has proof he was at work because the manager can vouch for him can that case also be dismissed?
