Legal Question in Criminal Law in Florida
I have been wrongfully accused of felony theft by a close relative's ex-girlfriend immediately after the two of them experienced a very nasty breakup. A false police report has been filed by the ex-girlfriend, and I have since been placed under police investigation based upon bitter accusations, empty speculation and dull suspicion.
I have been intimidated and threatened with arrest on multiple occasions by the investigating officer based on "probable cause" without the existence of any evidence to support the charges levied against me. According to the investigating officer, these threats weren't carried out solely because he didn't want to see my three children placed in the care of DCF.
I'm baffled over the investigating officer's unquestioned acceptance of these baseless and spiteful accusations as fact with no consideration given to the blatant lack of any supporting evidence. I'm equally baffled over the level of authority that has been invested into what is starting to feel more like police harassment than an investigation.
It's been three weeks and no charges have been filed, but I have retained an attorney to fight the charges levied against me, if and/or when they are filed. Accordingly, I've made the investigating officer aware that I've been advised by legal counsel to defer all discussion/interrogation regarding the open police investigation directly to my attorney's office, but the investigating officer has refused to acknowledge this notification. Upon initial notification via phone, the investigating officer hung up the phone upon my attempt to relay my attorney's contact information. When it has been brought up in person, he has disregarded my comments, entirely.
The investigating offer continues to come to my place of work multiple times per week to interrogate me while I am on my company's time. I am now being directed by the same investigating officer to make regular calls to him as an "alternative" to the multiple unannounced visits to my place of employment, which is in direct conflict with the legal counsel of my attorney.
The distracting police presence is starting to negatively impact my working relationships with both my superiors and my staff, and the mounting stress is having a noticeable effect on my overall work productivity. As a result of this endless goose chase of an investigation, I've been placed on administrative notice/warning and my continued employment is now in jeopardy. Do I have any options?
