Legal Question in Criminal Law in Florida
I wrote a check to a small business and the check was returned NSF. The small business informed me that I needed to pay the amount of the check, $19.50 plus $50.00 return check fee. I sent them a money order for $19.50 plus $25.00 which was what I found the statutory fee in florida was. The small business informed me that they have a sign in the window that informs customers that there will be a $50.00 fee for returned checks. My question is, do I have to pay more than $25.00 even though that is the statutory fee. I have been threated that they will prosecute through the state attorney's office because I still owe them $25.00. I sent the money order to them via certified mail.
