Most likely, the prosecutor will offer you pre-trial diversion. You may have to attend an anti-theft class. After completing the program the case against you will be dismissed. You will then be eligible to have your arrest record expunged. Be aware that the store will send you a civil demand for $200 (as authorized by Florida law), if you don't pay and they have to sue you, you will be responsible for additional legal fees. If it is your first criminal offense you may be eligible for a diversion program. This is a way for the State to get rid of your case without proceeding through the court system. Such a program usually involves classes, fines, restitution (repayment of items taken) and community service. Note that the program is not guaranteed and you normally have to meet a set of criteria.

If it is your first retail theft but not your first crime your are likely to be ineligible for the program.

Note that retail theft can be a misdemeanor or a felony. A felony carries prison sentence.

Consult with a local criminal defense attorney.
