Legal Question in Discrimination Law in Florida

Gender Discrimination

I work for a major corporation and believe my manager is discriminating against me because I am a man. There are only 3 people working under her, I’m the only man.

To date I haven’t lost wages. She only checks up on my work daily although I’m the only one who meets deadlines. She talks down to and about me in front of my peers, makes condescending comments about ''men'' and disciplinary actions have been taken against me but female employees have done the same without discipline. There are two sets of rules, one for me and another for the women who work with me.

I just contacted my HR department about the problem yesterday. I'm waiting to see what they do about it but I’m hoping you can tell me if there’s anything legally they’re required to do or if I have any legal options beyond HR. If she’s previously been reported for similar actions what course of action may be involved? If this is the first time a complaint has been filed then what? I'm trying to find out what to expect next. I'm sure my work environment will be even more uncomfortable once the complaint is dealt with if we’re still working together.

Re: Gender Discrimination

It would be a violation of emplyment laws for a company to have different terms and conditions of employment for men than they do for women. You have notified your HR department and I would expect them to investigate the issues you have raised. As to any other actions you would take, I would suggest you start by reading your employee handbook, if you have one. By the way, retaliating against an employee who makes a complaint of discrimination is wrong, even if the employee's complaint is unfounded. You may want to check out the EEOC website at www.eeoc.gov for general information or speak with an employment attorney in your area regarding specific questions.
