How do I could possitively identify a discrimination situation?
I work for a company that supposedly is multicultural. Well, not everything is bad in the company but the situation is with my boss. I am noticing different treatment between some associates and me (not only me). He is more addressed against the hispanic and foreigners population. For example, we have (we are two)15 minutes break (one in the morning-one in the afternoon)we cant take them because if he saw us sit he make us go back to work inmediately but there are associates that came down to smoke cigarrates and he dont said anything he even smoke with them. We ask for at least one saturday or one sunday off and even if a ask with two, six, eight months in advance inmediately is NO! because there is too much work (even in slow season)but there is other associates that he give them without no problem. He put in the Attendance Log absences that they dont exist and I find out that situation when I was absent by the very first time in a year and half working with them; We got 4 absences written down by him. I have absence when he wasnt the boss and my teammate even when she wasnt hire (I have evidence). These and more situations that I have written down in a journal that I keep everyday for me and my teammate.

Employment law requires that the terms and conditions of employment not be based on race or national origin. For an employer not to allow hispanic employee to take a break or schedule days off, while non-hispanic employees can take breaks and schedule days off, sounds like a violation of the law to me. I suggest you speak with an employment attorney. You can also obtain information on employment discrimination from the EEOC at www.eeoc.gov.
