Legal Question in DUI Law in Florida

Accident

Well i passed out at the wheel of my car at a stop sign in a grocery parking lot, but i must of hit the accelerator and went foward and hit two people by accident, i was out cold, what can be done to me, i have a history of seziuers from my doc. I wasnt drinking i just came from jury duty that morning

Hello:

I just read your question. I cannot give you a complete legal opinion of your situation as I do not have all of the facts. For example, were the people you hit hurt? This could make the charge a felony. Normally, a DUI is a misdemeanor, handled in county court.

Next, is this the first time you have been charged with DUI? A second or third DUI have increased penalties. If you were not drinking alcohol, they would have requested a urine sample to see if there were any illegal drugs in your system. If you refused to provide a sample or refused to perform field tests, they could have a weak case.

If you are actually charged with a DUI, you would be wise to hire an atty. The case will be on a Judge's calendar for arraignment where you plead not guilty and pass the case for a couple of weeks for a pre-trial. Yuor atty. will ask the State to provide copies of all the officer's reports. The case is passed for a few pre-trials until, perhaps, a deal is reached with the State that you want to accept or the judge sets the case for a jury trial at a later date.
