i got arrested for a dui on 8-19 - 2011 i knew that i was never told my miranda rights.....now i have dvd of arrest and still no eveidence of it being said to me.....can they get away with this even though its a dui case or do they have to tell me my miranda rights?

They are not "required" to read your Miranda. They only have to do that if they are asking you questions AND you are in custody. That doesn't mean that you don't have any defenses, but you should discuss all these issues with your attorney.
If they didn't read you Miranda rights, then any admissions you may have made may become inadmissible in court. You may also have other defenses and other issues that could be raised in your defense.
It would be wise to discuss your case with your attorney.
