My daughter has been in jail since January 2nd, 2010 on a hit and run charge.The case still has not been to trial. How long does she have to wait. I thought a person had a right to a speedy trial? The hit and run was in Palm Beach County Florida

The defendant if representing herself or himself, or the defense attorney has to file a motion for speedy trial. But it can only be done and should only be done if the defense is ready to go forward with trial. Perhaps the defense attorney is waiting for the statute of limitations to expire, but that would take a long time.
