Yes, you will be in violation of probation. Most prosecutors will ask for jail if you are caught driving while on probation for an alcohol related DUI. You face up to 90 days jail for a first offense plus whatever degree suspended license charge, which could be 60 days, 1 year, or 5 years jail. Point being don't drive until you get your license straightened out.

The primary purposes of probation are to ensure that you comply with the terms and conditions of your sentence and to sanction you should you fail. Therefore, it's not in your best interest to deliberately ignore the requirements and it's certainly not adviseable to violate the law by driving on a suspended license. The consequences for driving on a DUI suspension can be harsh, beginning with 30 days in jail or more & will generally include an additional license suspension. If you're having difficulty complying with the sentence due to financial problems, speak to your lawyer about your options. Being proactive could be the difference between resolving the conflict successfully or going to jail.
