I had DUI conviction in Aug 2009, there is DUI Diversion program for fist time offenders being put into effect in Miami, Fl. Can I benefit from this program?

We've had DUI Diversion here in Orlando for several years. The purpose of a diversion program is to allow the State Attorney's Office an alternative way to resolve cases outside of the typical court process, thereby lessoning the load and expense of prosecuting cases. It affords defendants an opportunity to earn a dismissal of their charges. Diversion is not intended for cases that are already resolved. Unless I misunderstand your question, you will not be able to benefit from DUI diversion for a case that has already been closed.
