Is it legal for a companyto refuse to hire a person because of a DUI?

This is one reason why a DUI conviction is so detrimental. The easy answer is yes. A DUI is a crime and will result in a criminal conviction if found guilty or pled guilty. Just because DUI is a misdemeanor doesn't mean it isn't given greater weight in the eye of the public. Many jobs require the employee to drive company vehicles. The company's car insurance carrier will most likely run checks on each employee's driving record and just like the employee's insurance rate goes up after a DUI so will the company's. Thus, company's are hesitant in hiring those people with DUI convictions. If the job doesn't involve driving, the company may still choose not to hire the individual based simply on the criminal history. A business has no obligation to hire anyone and may base their denial on almost anything except race, religion, sex, and gender. Sorry.
