Generally, if you DUI is a misdemeanor, the State has 2 years to file the charge. Usually, the State Attorney's Office (I previously worked in that same office for 6 years as one of their top DUI Manslaughter prosecutors) will wait until they get the results back from the Medical Examiner's Office to determine the blood alcohol level and/or whether there were any controlled substances in the blood.
