my friend was in the passanger seat of his car in florida sleeping he knew he had to much to drink and got in the passanger seat and fell asleep he was charged with dui this is in jacksonville fl
his keys were not in the inigtion but in his lap

This is a close call that probably only a jury can decide. He needs to talk to an attorney immediately about this to see what can be done to fight these charges.

RE: your question, The only way to give an opinion on these facts would be after reading what the officer wrote in the A&B. If there are no allegations the passenger was driving, he would have a good chance of getting the case dismissed.
