Legal Question in DUI Law in Florida

License

I was arrested for driving on a suspended license. I received notification from the State of Illinois, that my license where clear. I have a couple of questions. Is it possible to get my Florida license back? Another is to get this arrest off my record and have the charges lifted? Thank you for your time.

Hello: In response to your question, there are some facts I would need to know to give a legal opinion. Did you have a valid Fla. license? Is the case pending or concluded? What county is the case in? In our county, the State Attorney and the judges tend to give people a break on this charge if they come in with a good license. You can always call the dept. of highway safety and motor vehicles to find out if and why your license is suspended. You mention another state. You may need to contact its Dept. or Div. for licenses.

As to clearing your record, if the case is dropped, there is no conviction. If the case is pending, you need to ask for it to be dropped pr fight it and win or plead no contest and ask for a WITHHOLD OF ADJUDICATION OF GUILT. This means it is NOT a conviction. Under Fla. law, one can seal a prior arrest so long as it is not a conviction AND you have not been convicted on any other charge in the past.
