Open Container NOT in a vehicle
I was at a bar and stepped outside to have a cigarette with my beer. A policeman came up to me and gave me a ''paper arrest'' for an open container violation of a city ordinance (Miami). Now I have to go to court. Here are my questions: Do I need a lawyer? What should I expect out of this? Am I going to have a record? If my future employer does a background search will this come up?
Thank you for your help.

Re: Open Container NOT in a vehicle
It would be a good idea to speak with a lawyer. As it sounds like you have no prior arrest record, the attorney may be able to get the case thrown out prior to you going to court.
Or in the alternative they may be able to broker some type of agreement that will case the case from being filed.
If the case is not filed there would be no court record.
Even if it is filed we would most likely be able to keep it off your record.
If you would like to chat further I handle cases in Miami and would be glad to help.
Good luck,
