It will be charged as a second DUI outside 5 years. While there is no mandatory minimum jail time with that, often prosecutors want jail time. In addition, there will be a much higher fine, ignition interlock, and loads of other conditions. I suggest you talk to an attorney right away to see what can be done to minimize this.
