can a person take any legal action if a vehicle is impounded after suspicion of dui arrest is towed and all charges, fines etc dropped against towing co. for excessive charges

Probably not. The towing company is relying on the police who believe they have probable cause. If a prosecutor feels that the officer had probable cause and later determines it is not enough to convict beyond a reasonable doubt, which is their duty to determine. If you still feel wronged, you need to talk to A CIVIL attorney, not criminal.
