It is one year if there is no accident, BUT that means the state has one year to file charges or the citation. Since 99% of DUI cases, the person is served the ticket upon arrest, the statute of limitations is not usually an issue. For example, many people think that if your case is dragged on long enough then the SOL doesn't apply, but that is completely wrong. In other words, talk to your attorney to see if you have a real issue here.
